1. Are additional resources available to assist me with the ePortal application submission process?
Yes, the Solid Waste Management Section provides information to applicants during this process. Information may include guidance on completing forms, application of regulations, or technical guidance/published memos regarding common permitting topics. It should be noted that applications for solid waste facilities must be prepared under the supervision of a professional engineer registered in the State of Arkansas retained to represent the applicant. For landfills, a professional geologist registered in the State of Arkansas is also required.

2. What steps are involved in obtaining a permit for a landfill?
Please review Regulation 22 to identify which type of landfill you will need permitted. The Additional Link Section on the Solid Waste ePortal home page provides a link to Regulation 22. The permit process involves multiple steps including: obtaining local and regional approvals, pre-application submittal phase to the Division of Environmental Quality (DEQ) Solid Waste Management Section, application submittal phase to the DEQ-Solid Waste Management Section and the permit decision phase. Each phase requires various steps so please review the Permit Process under the Additional Links Section of the Solid Waste ePortal home page.
3. How do I fill out the application if my proposed activity consists of multiple solid waste activities requiring a permit - for example, a landfill facility with a compost facility?
Multiple applications and permits are required for each type of solid waste processing facility or landfill class. Please review Regulation 22 as provided in the Additional Links Section of the Solid Waste ePortal home page for further clarification of which permits and applications are required for each type of facility.

The Solid Waste Management Section - Technical Branch provides technical review during the permitting process and monitoring during the life of facilities.

Technical Assistance and Permitting

The Technical Branch of the Solid Waste Management Section is primarily responsible for permitting all solid waste management facilities. Permits are required for various classes of landfills, composting, transfer stations, material recovery, and waste tire processing facilities to protect from the potentially harmful effects of mismanaged solid waste.

The Technical Branch issues new permits and modifications to existing permits after reviewing and evaluating the permit applications for technical and regulatory compliance. Each permit must comply with the federal and state regulations.

Applicants follow a permitting process and are required to submit permitting fees.

Financial Issues

Technical Branch engineers have developed templates for cost estimate worksheets. These forms are provided to clarify or obtain more in depth details of the line item expenses generally seen in landfill closure and post-closure care cost estimates. Line items in these forms are neither all-inclusive nor all-applicable for every landfill. Every landfill has different types of expenses to be considered. An applicant's certifying engineer should include additional details as needed.

To minimize the threat of pollution, owners and operators of permitted solid waste facilities are required to provide financial assurance for closure, post-closure care, and corrective action.
