Individual National Pollutants Discharge Elimination System (NPDES) Permits

Wastewater, construction permit, stormwater, and pretreatment are managed through ADEQ’s NPDES permitting program. If you’re planning new or improved wastewater service for your facility; if you treat or process wastewater; if you are responsible for controlling storm water run-off at your facility, or if you have project plans that involve pretreatment, you may need a permit from ADEQ’s Office of NPDES Section. Working with ADEQ to obtain the correct permit will help you stay in compliance with environmental regulations. Failing to apply for an ADEQ permit or operating without the correct type of permit are violations.

Individual NPDES Discharge Permits Branch:

NPDES Individual permits are divided into two types:

Municipal Users  - Public or State (sanitary-type Dischargers)
  1. Major Municipals - A facility (Cities, Towns, Regional Sewer Districts) owned by a municipality with a design flow of 1 million gallons per day (mgd) or greater.
  2. Minor Municipals - Any municipally owned facility (Cities, Towns, Regional Sewer Districts) with a design flow of less than 1 mgd.
  3. State Owned - A facility owned or managed by a State agency (State parks, prisons, etc.)
  4. Federal - A facility owned by a federal agency (military owned installation, national park, federal penitentiary, etc.)
Industrial Users - (Wastewater generated in producing a product and sanitary)
  1. Majors - Any point source discharger which Major Rating Score of 80 and more
  2. Minors - All dischargers which are not designated as major
  3. Generals - The purpose of the general permit rule is to provide a streamlined NPDES permitting process for certain classes or categories of industrial point source discharges under the requirements of the applicable general permit rule rather than the requirements of an individual permit specific to a single discharge. Individual Permits

Individual permits are when one permit is issued for each application that is submitted. An individual permit allows the Department to put specific conditions in each permit. Most individual permits take 4 to 6 months to issue after the application is deemed administratively complete. Renewal applications are due 180 days before the date of permit expiration. Submitting an administratively complete application 180 days before the expiration date of the permit allows the existinig permit to continue in effect until the next permit is issued.

Non-Contact Cooling Water -   Modified ADEQ Form 1, EPA Forms 2E, ADEQ Disclosure Form (If Applicable)
Domestic Facilities -                  Modified ADEQ Form 1, EPA Forms 2E, ADEQ Disclosure Form (If Applicable)
Construction Permit -                Modified ADEQ Form 1
Permit Modification  -                 Modified ADEQ Form 1

The following applicable EPA Forms are required in addition to Form 1 for processing your application: (The applicable EPA forms are included at the end of each specific modified Form 1, this is where you can download and submit the applicable EPA Forms.)

Form 2A – Municipal Dischargers (POTWs)
Form 2B – Concentrated Animal Feeding Operations (CAFOs)
Form 2C – Existing Manufacturing, Commercial, Mining, and Silvicultural Operations
Form 2D – New Sources and New Dischargers Application for Permit to Discharge Process Wastewater
Form 2E – Facilities Which Do Not Discharge Process Wastewater
Form 2F – Application for Permit to Discharge Stormwater Discharges Associated with Industrial Activity
